Legal basis for collecting guest data
Spanish law requires every tourist accommodation to collect and report guest data to the authorities.
Royal Decree 933/2021 of 26 October sets out:
Mandatory collection of guests' identification data- Submission of guest reports to the competent authorities
- Secure storage of guest data
- A minimum retention period of three (3) years
It applies to:

Is guest registration mandatory in Spain?
Yes. Under Royal Decree 933/2021, every tourist accommodation in Spain must collect its guests' identification data and report it to the authorities through the official platform SES.Hospedajes.
This obligation applies to tourist apartments, holiday rental properties, hotels and property managers.
Do Airbnb or Booking register guests for me?
No. Platforms like Airbnb or Booking handle the booking, but they do not make the legal submission of guest reports to the Spanish authorities.
Responsibility for the registration and for submitting the data always rests with the owner of the accommodation.
When must guest reports be submitted?
Reports must be submitted within the legal deadline, normally within the first 24 hours of the guest's arrival, through SES.Hospedajes.
With EuroCheckin the submission happens automatically on the arrival date.
How long must guest data be kept?
The data must be kept for a minimum of three (3) years, in accordance with Royal Decree 933/2021.
Throughout that period it must be available to the competent authorities in the event of an inspection.
